In-tuition Driving School Terms and Conditions


All bookings are accepted on the strict understanding that the pupil has read, understood and accepted our terms and conditions.

By booking a course with In-tuition Driving School, you are indicating that you have read and understood the terms and conditions and that you agree to be bound by them.


a) 'you' means the person taking the course, ie the pupil.

b) 'we' 'us' means In-tuition Driving School.

c) 'the driving school' means a driving instructor acting on his/her own or on behalf of a driving school when providing the course.

Terms and Conditions

1. Each course is for the hours booked. Total hours of the course booked includes the time required for taking your practical test. Additional hours can be booked with your instructor at the agreed hourly rate, (this can be agreed between you the pupil and the instructor).

2. If your instructor feels that you are not ready to take your practical driving test, due to safety reasons, then you the pupil will not be allowed to take your driving test. If this is the case, you will not be offered a refund.

3. All deposits paid are non refundable.

4. If you, the pupil, cancel a course after the balance has been paid, a cancellation charge will be levied on the following basis.

10 hour course, or less, will be subject to a £100.00 cancellation charge.

15 hour course, or less, will be subject to a £150.00 cancellation charge.

20 hour course, or less, will be subject to a £200.00 cancellation charge

30 hour course, or less, will be subject to a £300.00 cancellation charge.

40 hour course, or less, will be subject to a £400.00 cancellation charge.

Guaranteed Pass Scheme 1 (certain areas only) will be subject to a £200.00 cancellation charge.

Guaranteed Pass Scheme 2 (certain areas only) will be subject to a £350.00 cancellation charge.

Guaranteed Pass Scheme 3 (certain areas only) will be subject to a £500.00 cancellation charge.

Any hours used on any course booked with In-Tuition Driving School, will be charged at our standard hourly rate (currently £25.00 per hour). Please note this is in addition to the cancellation charges detailed above.

If a course is cancelled by you the pupil and a free assessment lesson has taken place, then the cost of this (currently £25.00 per hour) will be deducted from any refund due.

5. If you the pupil cancel lessons at short notice (less than 48 hours before the arranged lesson), then the lesson is still chargeable at £25.00 per hour, or the hours booked will be deducted from the balance of the course.

6. If the course taken is the Guaranteed Pass Scheme, then any lessons cancelled by you, the pupil, without the 48 hour notice period, will be charged the standard hourly rate of £25.00 for the cancelled lesson. This must be paid directly to the instructor before any further lessons are taken.

7. When taking a crash/intensive course, it is not possible to drive continuously, therefore, short breaks can be arranged between you the pupil and your instructor.

8. In-tuition Driving School act soley as a booking and administrative agent for certain driving schools and instructors. This means that we do not provide any driving courses ourselves and we undertake all our activities on behalf of the driving schools or driving instructors. In-tuition Driving School is paid on commission.

9. All courses are booked and based on average learning capabilities and are a guide only. No guarantees can be implied.

10. A practical test cannot be booked until a pupil has successfully passed the theory test. Practical test availability is subject to tests made available by the DVSA. All attempts will be made by In-tuition Driving School to secure a practical test local to you the pupil.

11. The contract of the crash course/intensive course is between the pupil and the driving instructor. Any disputes, claims or discussions should therefore be addressed with the instructor and not In-tuition Driving School. In-tuition Driving School cannot be held liable for any compensation claim from a pupil, nor can it be held responsible for any traffic violation on the part of the pupil or the instructor.

12. In-tuition Driving School do not offer a first time pass guarantee.

The Course

a) All courses undertaken with In-tuition Driving School are on an individual basis. We do not offer shared courses.

b) No guarantee can be made of test availability. In the event that the test cannot be booked for the end of the course, then an alternative test will be offered for a date and time agreeable to the pupil, the instructor and us. No refund of any monies are applicable in this case. Also, if the DVSA cancels a test for whatever reason, then we cannot be held responsible/liable for the test fee and any time lost.

c) Whilst every effort is made to get the pupil to the required level to take the driving test, if it is thought by the instructor that the pupil's standard of driving falls below the required standard, then for the health and safety of the pupil, examiner and general public, the pupil will not be allowed to take the test. No test fee or course fee refund will be made in these circumstances.

d) If it is the instructor's opinion that you, the pupil, are not at a sufficient standard to drive the tuition vehicle from the place of pick up, or drive the tuition vehicle back to the place of pick up, then the lesson is still chargeable from the time of pick up, to the time of drop off. This is in the interests of health and safety of you, the pupil, and the general public.

e) All our instructors have been approved or licensed by the DVSA.

f) The car provided by the instructor will be comprehensively insured with a reputable insurer. A pupil can request to see insurance documentation from their instructor at any time. In-tuition Driving School cannot be held responsible for any insurance related claims. Any disputes are the responsibility of the instructor.

g) Refreshment breaks may form part of your daily tuition period.

h) The training vehicle will be in good working order and will be fitted with dual controls.

i) All special offers and course/lesson prices may be subject to change without notice and are at the discretion of the company.

j) If a gift voucher is supplied by In-tuition Driving School, then the voucher is valid for a maximum period of 3 months from the date of issue. Gift vouchers are to be used by the person or persons named on the voucher and are non-transferrable.

k) If payment is received by an instructor for a course of lessons and the pupil does not complete the course, then the remaining hours will be valid for a period of 6 months from the date of the last lesson. After this time, the lessons remaining will be forfeited and no refund will be given. However, in the event that the pupil requires a refund of any unused hours within the 6 month period, then the hours already used will be charged at the standard hourly rate (£25.00 per hour) and a cancellation fee may also apply.

l) When a pupil is successful and passes their practical driving test, any unused hours may only be refunded at the discretion of the instructor. The calculation of any refund will be based on the hours utilised being charged at the standard hourly rate of £25.00.

Your obligations

a) You are able to satisfy the driving test eyesight requirements of being able to read a vehicle number plate at a distance of 20.5 metres or 67ft.

b) You satisfy the DVLA/DVSA requirements regarding residency and eligibility requirements.

c) You attend your lessons on time. Failure to do so will result in you losing time and the driving school/driving instructor has no obligation in such circumstances to add time to the end of your lesson to make up time.

d) You must not be under the influence of drink or drugs at any time during the course. If we, or a representative of In-tuition Driving School detect any sign of this, the remainder of the course will be terminated and you will lose all fees paid.

e) A professional approach is required by the pupil and no abusive behaviour towards the instructor will be tolerated. The course will be terminated and any monies paid will be forfeited in such an event.

f) You supply on the first lesson a valid, signed UK provisional driving licence. If you fail to produce a valid UK provisional driving licence, the driving school/driving instructor cannot, by law, permit you to drive a car and accordingly your booking will be lost.

g) The construction, validity and performance of any contract shall be governed in all respects by the laws of England and Wales.


a) In-tuition Driving School are committed to protecting your privacy. We will only use the information that we collect about you lawfully - in accordance with the Data Protection Act 1998.

b) Any personal information we hold to process your booking will be held securely in accordance with the law and will not be sold or passed on to a third party.
